Montana's cannabis laws are pretty straightforward once you know them, but there are a few rules worth understanding before you shop. ๐ A Quick Bit of Background
Cannabis has come a long way in Montana, and Greenhouse Farmacy has had a front-row seat to all of it. When we opened our doors in Missoula back in 2018, recreational cannabis wasn't even on the horizon yet. Montana had a medical marijuana program, but it had spent years caught in a political back-and-forth that made access complicated and uncertain for patients who genuinely needed it. The dispensary landscape was small, cautious, and nothing like what you see today.
Then in November 2020, Montana voters passed Initiative 190, legalizing recreational cannabis for adults 21 and older. Adult-use sales officially launched on January 1, 2022, and Missoula has since grown into a well-established, thriving cannabis market with licensed dispensaries, lab-tested products, and a community of curious, educated consumers that we're proud to be part of.
One thing worth knowing is that cannabis sales aren't legal in every Montana county. The good news is that Missoula County is a "green county," meaning recreational cannabis is fully permitted here. If you're planning other stops around the state, it's worth checking local rules before you head out.

๐ชช Who Can Buy Cannabis in Missoula?
The rules on who can shop are simple:
- โ You must be 21 years of age or older
- โ You need a valid, government-issued ID:ย a driver's license, state ID, or passport all work
- โ Visitors and out-of-state residents are welcome:ย you do not need to be a Montana resident to purchase recreational cannabis
- โ International travelers are also welcome, as long as you have valid identification proving you're 21 or older
Every single purchase requires a valid ID. No exceptions, and we check every time. It's how we keep our community safe and our store compliant.
๐ How Much Can You Buy?
Montana sets clear limits on how much cannabis you can purchase per transaction. Here's what recreational shoppers can buy at one time:
- ๐ธ Flower: Up to 1 ounce (28 grams)
- ๐จ Concentrate: Up to 8 grams (or 8 milliliters) of concentrate containing up to 800 milligrams of Delta-9 THC per single packageย
- ๐ช Edibles: Products containing up to 800 milligrams of THC
Medical cardholders operate under a slightly different set of rules with higher monthly purchase limits and access to higher-potency products. If you're shopping recreationally, the limits above apply to you.
On the product side, there are also per-package THC limits set by the state. For edibles, a single package can contain no more than 100 milligrams of THC total, and a single serving cannot exceed 10 milligrams, so the products you'll find at Greenhouse Farmacy are already portioned and labeled to keep you within safe, legal territory.

๐ How Much Can You Have on You?
Buying and possessing cannabis are governed by slightly different rules:
- ๐ข On your person: Up to 1 ounce of cannabis at any time
- ๐ก At a private residence: Up to 1 ounce at home or on private property (unless you are harvesting from your legally grown home plants)
Montana residents can also legally grow their own cannabis at home, up to two mature plants and two seedlings per adult. Plants must be kept in a locked, private space that isn't visible from a public area.
โ Where You Can Use Cannabis
This is where a lot of people have questions, and the short answer is: private property only.
You can legally consume cannabis:
- ๐๏ธ In a private residence: your home, an Airbnb, a vacation rental, or anywhere else you're staying, as long as you have the owner's permission. It's always worth asking your host before assuming cannabis is welcome in their space.
That's the main rule. Private property with permission. Simple enough!

๐ซ Where You Cannot Use Cannabis
There are several places where cannabis consumption is off-limits, and it's important to know them:
- โ Public spaces: streets, parks, sidewalks, restaurants, bars, or anywhere that's not private property
- โ Federal lands: this includes National Parks like Glacier and Yellowstone. Cannabis is still a federal offense on federal land, regardless of Montana state law
- โ Indian Reservations: cannabis laws on tribal land are complicated and vary by tribe, since each nation has its own relationship with federal and state law. Don't assume state rules apply
- โ Hospitals, schools, and other restricted facilities
One way to think of it is if you wouldn't light a cigarette there, you probably shouldn't consume cannabis there either.
๐ Cannabis and Getting Around
In Your Car
You can legally drive with cannabis in your vehicle, but there are rules for how it has to be stored:
- ๐ Cannabis must be in its original, unopened packaging
- ๐งณ It must be stored outside the passenger area: in the trunk, a locked glove compartment, the truck bed, or behind the last upright seat if your vehicle doesn't have a trunk
- An open container of cannabis in your car is treated similarly to an open container of alcohol
Driving Under the Influence
This one is clear. Do not drive after consuming cannabis. Montana's DUI laws apply to cannabis just like alcohol. If you're impaired, you're breaking the law, and the penalties are serious.
Crossing State Lines
Do not cross state lines with cannabis in your possession, even into states where it may be legal. Montana's neighboring states of Idaho and Wyoming have strict laws against cannabis, and federal law prohibits transporting cannabis across state lines regardless of destination.
Flying with Cannabis
You cannot fly with cannabis, even on domestic flights departing from the Missoula Airport. Airports are federally regulated spaces, and cannabis remains a federal offense regardless of state law.
๐ฐ Taxes and Paying for Cannabis
What to Expect at the Register
Montana's recreational cannabis is subject to a 20% state excise tax, plus a local option tax of up to 3%. Missoula County does add the additional 3%, so plan accordingly when budgeting for your visit.
Medical cannabis patients with a valid Montana medical card pay a much lower tax rate of 4%, which is one reason some patients maintain their cards even as recreational options expand.
Bring Cash
Nearly all cannabis dispensaries in Montana, including Greenhouse Farmacy, primarily operate on cash transactions due to ongoing federal banking restrictions affecting the cannabis industry. We do have an ATM on-site if you need it.ย
๐ฅ What About Medical Cannabis?
If you're a registered medical cannabis patient, Montana's program offers some meaningful benefits beyond recreational options:
- ๐ Lower taxes: medical purchases are taxed at 4% rather than 20%
- ๐ Higher purchase limits: medical patients can purchase up to 5 ounces per month with a daily limit of 1 ounce, but their personal possession limit at any one time is still 1 ounce
- ๐ Access to higher-potency products: medical patients are exempt from the 35% THC potency cap placed on recreational flower, so products above recreational THC limits are available to registered cardholders
Montana does not automatically recognize out-of-state medical cards, so if you're visiting from another state, you'll most likely be shopping as a recreational customer. Our budtenders can help you navigate your options when you come in.
